Please read these Terms of Use (“Terms”) carefully before using the website located at blueskydecks.com (the “Site”), operated by Blue Sky Decks (“Company,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

The Site is provided to give you information about Blue Sky Decks’ residential deck construction, repair, maintenance, and related outdoor living services, to allow you to request consultations or quotes, and to access our online login/payment portal. You agree to use the Site only for lawful purposes and in accordance with these Terms.

While we assist customers with navigating applicable permitting processes as part of contracted projects, use of this Site does not constitute permitting advice, and you remain responsible for confirming applicable local requirements as part of any project agreement with us.

Our Site provides a link to a third-party hosted “Login / Pay Online” portal (currently operated by Thryv) for account access and online payments. Use of that portal is subject to the separate terms and privacy policy of that third-party provider. We are not responsible for the availability, functionality, or security practices of third-party platforms linked from our Site.

All content on the Site — including text, graphics, logos, images, photographs of completed projects, videos, and the overall design and layout — is the property of Blue Sky Decks or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and print content from the Site for personal, non-commercial reference only. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

TO THE FULLEST EXTENT PERMITTED BY LAW, BLUE SKY DECKS AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT, IF ANY, YOU PAID TO US FOR ACCESSING OR USING THE SITE ITSELF.

This limitation does not apply to obligations arising under a separate signed construction or service agreement, which is governed by its own terms.

You agree to indemnify, defend, and hold harmless Blue Sky Decks and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your misuse of the Site.

These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state or federal courts located in Kootenai County, Idaho.
